Construction Hub is solely an online advertising, listing, discovery and connection platform.

Construction Hub provides a digital space through which independent users may advertise, discover and contact sellers, buyers, vendors, contractors, professionals and service providers.

Construction Hub is not a party to any transaction, contract, quotation, payment, meeting, site visit, purchase, sale, service engagement or other arrangement entered into between users.

Construction Hub does not act as the seller, buyer, contractor, subcontractor, employer, employee, agent, broker, guarantor, insurer, supervisor or representative of any user unless expressly agreed otherwise in a separate written agreement.

All dealings are directly and independently between the relevant users.

Every user accesses and uses Construction Hub and contacts or deals with other users entirely at their own discretion and risk.

Users are solely responsible for conducting whatever due diligence they consider necessary before:

• Contacting another user
• Purchasing any product
• Hiring any person or company
• Making or receiving payment
• Entering into any contract
• Sharing information
• Visiting any location
• Inviting anyone to their property
• Allowing access to a home, office, shop, factory or construction site
• Accepting delivery
• Commencing any work

Construction Hub has no duty to supervise transactions or interactions between independent users.

Construction Hub makes no guarantee or warranty regarding any user's:

• Identity
• Character
• Conduct
• Honesty
• Financial standing
• Qualifications
• Skills
• Experience
• Licensing
• Products
• Services
• Pricing
• Availability
• Workmanship
• Safety
• Reliability
• Performance

Construction Hub also does not guarantee the accuracy, authenticity, legality, completeness or availability of any advertisement, listing, photograph, description, quotation, review, rating or other user-generated information.

A Verified Badge means only that Construction Hub has reviewed certain information or documentation submitted or made available for verification at a particular time.

Verification does not constitute a warranty, guarantee, recommendation, certification or endorsement of that person or business.

A Verified user remains an independent third party.

Users remain solely responsible for conducting their own due diligence before dealing with a Verified user.

Construction Hub does not control, supervise or assume responsibility for meetings or physical interactions arranged between users. This includes:

• Home visits
• Construction-site visits
• Property inspections
• Office meetings
• Shop visits
• Deliveries
• Installations
• Repairs
• Surveys
• Consultations
• Measurements
• Inspections
• Any other physical interaction

To the maximum extent permitted by applicable law, Construction Hub shall have no liability for acts or omissions of independent users during such interactions, including claims involving:

• Theft
• Robbery
• Fraud
• Property damage
• Personal injury
• Harassment
• Threats
• Assault
• Misconduct
• Criminal activity
• Accidents
• Death
• Any other loss, damage or incident

Users independently decide whom they meet and whom they permit to enter their property.

Construction Hub does not manufacture, supply, inspect, install, warrant or guarantee products listed by independent vendors unless expressly stated otherwise.

Construction Hub does not perform, supervise, inspect or guarantee services advertised by independent providers unless expressly stated otherwise.

Accordingly, Construction Hub assumes no responsibility for claims arising from independent users' products or services, including:

• Defective products
• Counterfeit products
• Incorrect specifications
• Product failure
• Unsafe products
• Poor workmanship
• Construction defects
• Delays
• Abandonment of work
• Overcharging
• Underperformance
• Non-performance
• Damage caused during work
• Warranty disputes

All such matters are between the customer and the relevant independent vendor or service provider.

Unless Construction Hub expressly provides a payment service subject to separate terms, Construction Hub is not involved in payments between users.

Users make and receive payments entirely at their own risk.

Construction Hub shall not be responsible for independent-user conduct involving:

• Advance payments
• Deposits
• Tokens
• Non-payment
• Chargebacks
• Fake payment confirmations
• Payment fraud
• Failure to refund
• Non-delivery
• Misappropriation
• Financial scams

Users are responsible for verifying payment information and maintaining appropriate documentation.

To the maximum extent permitted by applicable law, Construction Hub, its owners, shareholders, directors, officers, employees, representatives, affiliates and associated entities shall have no liability for any loss, damage, claim, cost, injury or expense arising from or relating to:

• Use of the platform
• Inability to use the platform
• User-generated listings
• Communications between users
• Products or services supplied by users
• Transactions between users
• Payments between users
• Fraud or misconduct by users
• Physical meetings
• Site or property visits
• Accidents
• Property damage
• Personal injury
• Criminal conduct by third parties
• Loss of money
• Loss of property
• Loss of profit
• Loss of business
• Loss of opportunity
• Loss of data
• Project delays
• Project failure
• Product failure
• Service failure
• Reliance on listings, reviews or other user-generated information

This exclusion applies whether the claimed loss is direct, indirect, incidental, consequential, special, economic or otherwise, to the fullest extent such exclusion is legally enforceable.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

To the maximum extent permitted by law, each user releases Construction Hub and its owners, directors, officers, employees, representatives and affiliates from claims arising out of disputes, transactions or interactions between that user and another independent user of the platform.

If a dispute arises between users, the users are responsible for resolving that dispute between themselves through whatever lawful remedies are available to them.

To the maximum extent permitted by applicable law, each user agrees to defend, indemnify and hold harmless Construction Hub, its owners, shareholders, directors, officers, employees, representatives, affiliates and associated entities from and against claims, demands, actions, proceedings, damages, losses, liabilities, penalties, fines, costs and reasonable legal expenses arising from or relating to:

• The user’s use of Construction Hub
• The user’s listings or advertisements
• Products sold or supplied by the user
• Services provided by the user
• Statements or representations made by the user
• Transactions entered into by the user
• Payments or payment disputes
• Meetings or site visits involving the user
• Property damage caused by the user
• Injury allegedly caused by the user
• Fraud or misconduct by the user
• Violation of law by the user
• Breach of these Terms
• Breach of another person’s rights
• Intellectual-property infringement
• False, inaccurate or misleading information
• Forged or fraudulent documents
• Tax or regulatory obligations of the user
• Employment or labour claims relating to the user
• Claims brought by customers or other third parties relating to the user’s products, services or conduct

This indemnity survives suspension, deletion or termination of the user's Construction Hub account.

Nothing on Construction Hub creates any employment, partnership, joint venture, franchise, agency or fiduciary relationship between Construction Hub and any vendor, contractor, professional or other user.

The fact that a user is listed, verified, featured, boosted or premium does not make that user an employee, agent, representative or partner of Construction Hub.

Payment for a Product Booster, Service Booster, Premium Booster or other advertising placement purchases increased promotional exposure only.

Construction Hub does not guarantee:

• Leads
• Calls
• Enquiries
• Customers
• Sales
• Contracts
• Projects
• Revenue
• Profit

Boosting a listing does not constitute Construction Hub's endorsement of the advertiser.

By using Construction Hub, users acknowledge that information and content may be processed for legitimate platform purposes including:

• Operating Construction Hub
• Analytics
• Security
• Fraud detection
• Search and recommendations
• Product development
• Platform improvement
• Marketing and promotions
• Advertising
• Business intelligence
• Development, evaluation and improvement of internal automated and AI-assisted systems

Construction Hub may also use listing content, photographs, descriptions and other content submitted for publication to operate, advertise and promote Construction Hub and its services, subject to applicable law and the Privacy Policy.

Any processing requiring specific consent under applicable law will be handled through the appropriate consent mechanism.

Private identity and verification documents shall not be publicly displayed.

Each vendor or service provider is independently responsible for:

• Required licences
• Registrations
• Permits
• Professional approvals
• Taxes
• Labour obligations
• Insurance
• Product compliance
• Consumer obligations
• Safety requirements
• Applicable laws and regulations

Construction Hub's acceptance of a listing does not constitute confirmation that the advertiser has satisfied every legal requirement applicable to their business.

Construction Hub reserves the right, subject to applicable law, to remove, restrict, suspend or terminate accounts, listings or Verified status for reasons including:

• Suspected fraud
• False documents
• Misrepresentation
• Complaints
• Abuse
• Illegal activity
• Safety concerns
• Fake reviews
• Platform manipulation
• Violation of these Terms

Such action does not create an obligation for Construction Hub to investigate or police every user or transaction.

Clauses concerning:

• Limitation of liability
• Release
• Indemnification
• Intellectual property
• Data processing
• User responsibility
• Dispute obligations

shall survive termination or deletion of an account to the extent legally applicable.
